Terms of Service for JetCompare.co.uk

 

Effective Date: 1 September 2023

Parties

Charterer: The JetCompare Member, including its representative(s), making the Flight booking using www.jetcompare.co.uk, with details as set out in a Charter Contract.

 

Carrier: The Aircraft Operator whose quotation for the provision of a Flight to the Charterer has been accepted by the Charterer in accordance with an Agreement and the terms of www.jetcompare.co.uk, as detailed in a Charter Contract.

 

Scope

JetCompare operates as an intermediary, facilitating private jet charter services through its online technology platform. When you book a charter flight through JetCompare, you enter into a direct and legally binding relationship with the aircraft operator. JetCompare’s role is to assist you throughout the booking process and ensure a seamless experience.

 

1. Acceptance of Terms

Welcome to JetCompare.co.uk (“JetCompare,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the JetCompare.co.uk website (the “Website”) and the services provided through the Website. By accessing or using the Website and our services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Website or our services.

 

2. Service Description

Jetcompare.co.uk provides private jet charter services, including booking and reservation of private jet flights.

 

3. User Eligibility

You must be at least 18 years old to use our services.

 

4. Definitions

In these Standard Charter Terms, the following definitions apply:

 

Agreement: Refers to these Standard Charter Terms, the Charter Contract, and any Special Conditions.

 

Aircraft: Any aircraft, including helicopters, used in connection with a Flight.

 

Charter Price: The total amount specified in JetCompare invoices for a single Agreement, including JetCompare’s facilitation fee.

 

Flight: A flight as described in a Charter Contract.

 

Charter Contract: The online confirmation issued to the Charterer by www.jetcompare.co.uk confirming an aircraft charter and Flight details.

 

JetCompare: JetCompare, a London, UK-based private aircraft charter brokerage with a UK address at 21 Soho Square, Soho, London, W1D 3QP and registered number 124377.

 

JetCompare Exchange Rate: The midpoint rate published on www.oanda.com, plus a 2% currency administration fee.

 

JetCompare Members: Individuals subscribing to JetCompare’s services through www.jetcompare.co.uk or any mobile application provided by JetCompare.

 

JetCompare Tender Process: The online process through which the Charterer submits a request for fulfilling a Flight requirement. Aircraft Operators respond with quotations and details of any Special Conditions or Charterer requirements.

 

Special Conditions: Variations to the Standard Charter Terms that specify how the Carrier will perform the Flight for the Charterer. In case of inconsistency with the Standard Charter Terms, Special Conditions take precedence.

 

5. Charter

4.1 The Carrier shall provide the Aircraft to the Charterer as specified in a Charter Contract, and the Charterer shall charter the Aircraft from the Carrier under the terms and conditions of the Agreement, including any Special Conditions communicated during the JetCompare Tender Process.

 

6. Charter Price and Payment

 

6.1 JetCompare offers a payment gateway for Aircraft Operators through its services at www.jetcompare.co.uk. The Charterer shall pay the Charter Price to JetCompare as specified in the Charter Contract.

 

6.2 The Charter Price is based on aviation fuel costs calculated on the Booking Date. If there is an increase in the cost of aviation fuel between the Booking Date and the date of Flight, the Charterer may be required to pay JetCompare an additional amount to compensate the Carrier for the increased costs.

 

6.3 Failure to make payments by the due date may result in interest charges, as specified in these Terms.

 

6.4 The Charter Price is agreed upon in the currency stated in the Charter Contract. JetCompare may accept payment in US Dollars, Euros, or GBP Sterling, at its discretion. The exchange rate used for conversion will be determined by JetCompare.

 

6.5 Payment of the Charter Price must be made directly to the account specified by JetCompare, authorised to accept payment on behalf of the Carrier. Full payment is required upon receiving the invoice unless otherwise specified.

 

6.6 No set-off or counterclaim will entitle the Charterer to withhold payment of any sums payable under an Agreement.

 

6.7 The Charterer is responsible for reimbursing the Carrier for any de-icing costs incurred during the Flight. The Charterer may purchase a de-icing waiver through JetCompare. If not purchased, JetCompare will place a credit card hold for the approximate de-icing cost, to be released upon full settlement of the related invoice.

 

6.8 Requesting changes to routing or significant changes in Flight details may result in additional costs payable by the Charterer.

 

6.9 JetCompare deducts a facilitation fee from the Charter Price before remitting funds to the Carrier.

 

6.10 Credit card surcharge fees may apply to payments made by credit or debit card, subject to applicable regulations.

 

7. Privacy and Data Security

Your use of our services is also governed by our Privacy Policy, which can be found at https://jetcompare.co.uk/privacy/. We take data security seriously and implement measures to protect your information.

 

8. User Conduct

You agree not to:

 

  • Violate any applicable laws or regulations.
  • Engage in any fraudulent or unlawful activities.
  • Misrepresent your identity.
  • Use our services for any illegal or malicious purposes.

 

9. Intellectual Property

All content on JetCompare.co.uk, including text, graphics, logos, and images, is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from our site without our explicit consent.

 

10. Disclaimer of Warranties

We make no warranties regarding our services’ availability, accuracy, or reliability.

 

11. Traffic Documents

When necessary, the Carrier will supply or obtain all required documents for the carriage and Flight under an Agreement. The Charterer must provide the necessary information and assistance to complete these documents.

 

12. Exclusion of Liability/Indemnity

 

12.1 JetCompare maintains non-owned aircraft liability insurance. Except where required by applicable regulations or covered by JetCompare’s insurance, JetCompare assumes no responsibility or liability for activities performed by any Aircraft Operator. The Aircraft Operator is solely responsible for claims arising from occurrences on or related to the Aircraft, including personal injuries, property damage, or wrongful death.

 

12.2 The Charterer agrees to indemnify and hold harmless the Carrier, JetCompare, and their respective officers, employees, servants, and agents against any claims, demands, liabilities, actions, proceedings, and costs arising from the Charterer’s or their passengers’ failure to comply with Agreement provisions.

 

12.3 These indemnities survive the termination of an Agreement.

 

13. General Provisions

13.1 Entire Agreement. These Terms constitute the entire agreement between you and JetCompare.co.uk regarding your use of the Website and the Services, superseding any prior agreements, understandings, or representations.

 

13.2 Waiver and Severability. The failure of JetCompare.co.uk to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

 

13.3 Assignment. You may not assign or transfer these Terms, in whole or in part, without JetCompare.co.uk’s prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without your consent.

 

13.4 Headings. The section headings in these Terms are for convenience only and have no legal or contractual effect.

 

13.5 Amendments. We may modify, update, or revise these Terms at any time, and such changes will become effective upon posting. We will notify you of any material changes to these Terms via email or through the Website. Your continued use of the Website and Services after the effective date of any such changes constitutes your acceptance of the revised Terms.

14. Termination

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
